Details

The form must be sworn on oath or affirmed. An affirmation is a non-religious statement that has the same legal effect as an oath sworn on a religious text.

The affidavit can be sworn or affirmed by a solicitor, notary or commissioner for oaths (for a charge) or by an authorised member of court staff.

If the affidavit relates to proceedings in the High Court and the affidavit is sworn or affirmed by a court officer, you will need to pay a fee.

Court staff can only swear or affirm affidavits that relate to court proceedings.
